Terms of Service for Plass Test

These Terms of Service (“Terms”) govern your use of the Plass Test website at plasstest.com (the “Site”), owned and operated by R. K. Trading Co., Prayagraj - proprietor Ravinder Kumar Nayar — under the registered brand Plass Test.

By visiting the Site, sending us an enquiry, or interacting with us through any link the Site provides, you accept these Terms. If you don't agree with any part of them, please don't use the Site.

1. Who we are

Plass Test is a Prayagraj-built PVC and allied-products brand serving farmers, plumbers, electricians, contractors, builders, dealers and distributors across Uttar Pradesh, Madhya Pradesh, Bihar and the wider north-Indian market. 2. Who may use the Site

The Site is meant for adults (18 years or older) who are interested in our products as a buyer, dealer, contractor or trade partner. By using the Site you confirm you are at least 18 and have the legal capacity to enter into a contract under Indian law.

3. The website is informational

The Site exists to introduce the Plass Test brand, list our products, and let you send us an enquiry. No transaction, payment, order confirmation or delivery commitment is concluded online. Every order is finalised offline - over WhatsApp, on a phone call, or face-to-face with our team - and only after we mutually confirm quantity, size, price, dispatch terms and payment method.

4. Product information & specifications

We work hard to keep specifications, sizes, colours and product images on the Site accurate, but they are indicative. PVC is an extruded material and small batch-to-batch variations in shade, print or wall finish are normal. Where a project has critical tolerances, please confirm the exact spec for that batch with our team before placing a bulk order.

5. Prices & quotes

Prices are not published on the Site because they vary by quantity, size, dispatch destination, current PVC raw-material cost and GST applicability. Any quote we share by WhatsApp, email or in person is valid only for the period stated in that quote and is subject to stock availability at the time of order confirmation. All applicable taxes will be charged as per prevailing GST rates on the date of invoice.

6. Your enquiry

When you submit the enquiry form on /contact or message us on WhatsApp, you agree that the details you provide (name, phone, email, city, state, requirement) are true and current, and that we may contact you on the phone number and email you shared to discuss your enquiry. How we handle that data is described in our Privacy Policy.

7. Acceptable use

You agree not to:

  • submit false, misleading or impersonated enquiries on the Site
  • use the Site, our WhatsApp number or our email to send spam, bulk solicitations or any unlawful content
  • attempt to break into, scrape, scan, overload or reverse-engineer any part of the Site or its hosting infrastructure
  • copy, mirror, frame or republish substantial portions of the Site content without our written permission
  • represent yourself as a Plass Test dealer, distributor, agent or employee without our written authorisation

8. Brand & intellectual property

Plass Test is a registered Indian trademark of R. K. Trading Co. - Application 4121846, Class 19, valid through 18 March 2029. The wordmark, the orange swoosh, the colour system, the product photography, the page copy, the Hindi/Roman lockup, and all other brand assets on the Site are owned by R. K. Trading Co. and protected under the Trade Marks Act, 1999 and the Copyright Act, 1957.

You may not use the Plass Test name or any of these assets on packaging, signage, invoices, social media handles, marketplace listings, or anywhere else to suggest affiliation with us unless you are a written-confirmed Plass Test dealer or distributor.

9. Dealer & distributor representations

Only persons we have specifically authorised in writing are Plass Test dealers or distributors. If someone in the market represents themselves as our dealer and you're unsure, write to plasstestco@gmail.com with the name and city - we'll confirm in one business day. R. K. Trading Co. is not responsible for representations, promises, warranties or after-sales claims made by anyone who isn't actually our authorised dealer.

10. Product warranty

Warranty terms vary by product line, packaging batch and the invoice issued at the time of dispatch. Our warranty covers manufacturing defects in 100% virgin PVC stock for the period indicated on that invoice, and is subject to the product being installed and used as intended (e.g. casing pipes used inside the specified pressure rating, hot-water lines used inside the specified temperature limit). Cracks caused by hammering, vehicular crushing, exposure beyond rated UV/temperature, or use with non-PVC chemicals are not covered.

Warranty claims must be raised directly with us - not with the transporter or the dealer - and supported by the original invoice and photographs of the affected pipe with its printed batch code visible.

11. Third-party services & links

The Site uses or links to a few third-party services to function - Vercel (hosting), Formspark (enquiry form backend), Cloudflare Turnstile (bot-check), Make.com (internal notifications), WhatsApp (chat link), Google Fonts (typefaces) and Google Maps (office address link). These are operated by their respective companies under their own terms; we are not responsible for changes in their behaviour or availability.

12. Site availability & changes

We aim to keep the Site online and accurate at all times, but we don't guarantee uninterrupted access. We may add, remove, rename or restructure pages, change product photography, retire a product, change spec text, or take the Site down for maintenance, with or without prior notice. Continuing to use the Site after such a change means you accept the change.

13. Disclaimers

The Site is provided on an “as is” and “as available” basis. To the extent allowed by Indian law, we disclaim implied warranties of merchantability and fitness for a particular purpose with respect to the Site itself. The contents of the Site are not professional engineering, plumbing or electrical advice. Please consult a qualified contractor for your specific installation.

14. Limitation of liability

To the maximum extent permitted under Indian law, R. K. Trading Co., its proprietor, employees and agents will not be liable for indirect, incidental, special, consequential or exemplary damages (including lost business, lost goodwill, lost data or project-delay costs) arising from your use of the Site. Our aggregate liability arising from or relating to your use of the Site itself (separate from any goods you purchase from us) will not exceed ₹1,000. This clause does not limit any statutory rights you have as a consumer under the Consumer Protection Act, 2019 in respect of goods you actually purchase from us.

15. Force majeure

We will not be liable for delays or failures caused by events beyond our reasonable control, including raw-material shortages, transport strikes, fuel disruptions, communal disturbances, floods, cyclones, fires, pandemics, electricity outages, internet outages, or government action affecting either Prayagraj or the dispatch route.

16. Indemnity

You agree to indemnify and hold R. K. Trading Co. harmless from any claim or loss arising from your misuse of the Site, your breach of these Terms, or your unauthorised use of the Plass Test brand.

17. Governing law & jurisdiction

These Terms are governed by the laws of the Republic of India. Any dispute arising from the Site or these Terms will be subject to the exclusive jurisdiction of the competent courts at Prayagraj, Uttar Pradesh.

18. Compliance with Indian IT & data laws

We make reasonable efforts to comply with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Digital Personal Data Protection Act, 2023. If you believe any content on the Site is unlawful or infringes your rights, please write to our Grievance Officer (below) and we'll review your request within the timelines those rules specify.

20. Changes to these Terms

We may revise these Terms from time to time. Any update will be posted on this page with a new “last updated” date. Continuing to use the Site after an update is your acceptance of the revised Terms.

21. Severability

If a court holds any part of these Terms invalid or unenforceable, the rest will continue in force.
